Terms of Use

These Terms of Use ("Terms") govern access to and use of the vehicle-rental services provided by the WIGO entity ("WIGO", "we", "us", or "our"), including the WIGO website, mobile applications, APIs, customer support, and related tools.

By creating an account, listing a vehicle, making or accepting a reservation, or otherwise using WIGO, you agree to these Terms. If you do not agree, do not use the service.

1. Wigo marketplace role

WIGO operates a vehicle-rental marketplace that enables vehicle owners or authorized hosts to publish listings and eligible renters to reserve vehicles. Unless a booking flow expressly states that WIGO is the vehicle supplier, the host supplies the vehicle and WIGO provides the technology, payment, communication, and support tools used to arrange the rental.

Additional rules, prices, cancellation terms, insurance information, or market-specific conditions shown during booking form part of the agreement for that rental. If those terms conflict with these Terms, the more specific booking or mandatory legal term applies to that rental.

2. Eligibility

Users must be legally capable of entering a binding agreement. Renters and drivers must satisfy the age, identity, driver's-license, payment, insurance, and other legal requirements applicable in the location where the vehicle is rented and driven.

Only drivers approved through the WIGO booking may drive a rented vehicle. WIGO may request additional information, refuse verification, or restrict access where a person does not meet eligibility requirements or presents a safety, legal, or fraud risk.

3. Accounts and security

Users must provide accurate, current, and complete information and keep it updated. You are responsible for protecting account credentials and for activity carried out through your account, except where applicable law provides otherwise.

You must not share an account, impersonate another person, create false accounts or listings, submit altered or misleading documents, or use another person's identity, driver's license, payment method, or account without authorization. Notify WIGO promptly if you suspect unauthorized access.

4. Host and vehicle responsibilities

Hosts must:

  • have the legal right and any required authorization to list and rent each vehicle;
  • provide accurate information about ownership, registration, condition, mileage, location, price, features, restrictions, and availability;
  • maintain the vehicle in a safe, clean, roadworthy, and legally compliant condition;
  • maintain required registration, inspections, permits, and insurance;
  • disclose known defects, damage, recalls, tracking devices, or safety concerns;
  • provide the vehicle, keys, documents, and agreed equipment at the confirmed time and place; and
  • cooperate with renters, WIGO, insurers, and authorities in relation to incidents or disputes.

WIGO may review, approve, reject, hide, suspend, or remove a listing where reasonably necessary for safety, quality, fraud prevention, legal compliance, or platform integrity.

5. Listings and reservations

Vehicle photos, descriptions, prices, availability, pickup details, mileage limits, geographic restrictions, and included features must be reviewed before booking. A reservation is confirmed only when the service displays confirmation and any required payment or authorization succeeds.

Users must not arrange a WIGO-initiated rental outside the platform to avoid fees, verification, safety processes, payment protections, or other booking requirements.

6. Renter and driver responsibilities

Renters and authorized drivers must:

  • inspect the vehicle and report existing damage or safety concerns before driving;
  • use the vehicle carefully, lawfully, and only for permitted purposes;
  • follow road rules, geographic limits, mileage limits, fuel or charging requirements, and host instructions consistent with the booking;
  • secure the vehicle and keys when unattended;
  • allow only approved drivers to operate the vehicle;
  • stop using the vehicle and contact WIGO or emergency services when continued use may be unsafe; and
  • return the vehicle on time, to the agreed location, in the agreed condition, with the agreed fuel or battery level and equipment.

The vehicle must not be used for racing, driver training, towing without authorization, unlawful transport, carrying hazardous materials, overloading, off-road driving where prohibited, sub-rental, rideshare or delivery work unless expressly allowed, or operation while impaired, fatigued, unlicensed, or medically unfit.

7. Pickup, trip documentation, and return

Hosts and renters should follow the pickup and return process shown in WIGO. Users may be required to take timestamped vehicle-condition photos, verify mileage and fuel or battery level, report damage, and confirm key transfer.

Failure to complete required documentation may affect the ability to establish the vehicle's condition or resolve a claim. A late, abandoned, unauthorized, or improperly returned vehicle may result in additional charges, recovery action, suspension, or reports to authorities where appropriate.

8. Prices, payments, deposits, and payouts

Users agree to pay the rental price and all applicable taxes, fees, deposits, extensions, fuel or charging costs, excess mileage, cleaning charges, late fees, damage amounts, fines, tolls, recovery expenses, and other amounts disclosed in the booking or validly incurred under these Terms.

Payments may be handled by third-party processors. WIGO may place payment authorizations, collect amounts when due, correct processing errors, and delay, withhold, reverse, or adjust payments or host payouts where reasonably necessary for refunds, chargebacks, fraud reviews, disputes, legal compliance, or amounts owed.

Hosts are responsible for the accuracy of payout information and for taxes or reporting obligations associated with rental income, except where WIGO is legally required to collect, withhold, or report amounts.

9. Cancellations, changes, and refunds

Cancellation deadlines, extension rules, no-show treatment, and refund eligibility may vary by booking and are displayed in the service. A requested change or extension is effective only when approved through WIGO.

WIGO may cancel, shorten, or refuse a rental where reasonably necessary because of payment failure, inaccurate information, vehicle unavailability, a safety issue, suspected fraud, legal requirements, severe service disruption, or a violation of these Terms. Any refund will be determined by the applicable booking terms, the circumstances, mandatory law, and amounts already incurred.

10. Safety, incidents, and disputes

Users must promptly report accidents, damage, theft, breakdowns, impoundment, safety defects, injuries, police contact, and other serious events. In an emergency, contact local emergency services first.

Users must not admit liability, promise payment, conceal evidence, arrange an unauthorized repair, or leave a disabled vehicle without taking reasonable steps to secure it and notify WIGO. Users must cooperate with reasonable requests for statements, photos, identity and license information, trip records, police reports, repair estimates, and insurance documents.

WIGO may review trip and account records, facilitate communications, request evidence, place temporary payment or account restrictions, and cooperate with insurers, claims handlers, professional advisers, payment providers, and authorities. WIGO's operational review does not replace a court, insurer, or competent authority.

11. Insurance, damage, fines, and tolls

Insurance availability, coverage, exclusions, deductibles, and claims procedures may vary by vehicle, host, driver, booking, and jurisdiction. Users must review the insurance information presented for the rental and maintain any independently required coverage. WIGO does not promise coverage beyond the terms expressly provided for a booking.

The responsible user may be charged for damage, loss, theft, towing, storage, diminished value where legally recoverable, administrative costs, fines, tolls, penalties, or other losses arising during a rental, subject to evidence, the booking terms, insurance, and applicable law.

12. Reviews and user content

Users may submit profile information, vehicle photos, listing content, trip photos, reviews, messages, and support materials. You retain ownership of your content but grant WIGO a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, adapt, and use it as reasonably needed to operate, secure, support, and promote WIGO.

You must have the rights and permissions needed to submit content. Content must be accurate where it describes a vehicle or rental and must not be unlawful, deceptive, threatening, discriminatory, defamatory, invasive of privacy, or infringing. WIGO may remove or restrict content that violates these Terms or creates legal, safety, or trust concerns.

13. Prohibited conduct

Users must not:

  • use WIGO for illegal, fraudulent, abusive, discriminatory, dangerous, or harmful activity;
  • manipulate reservations, payments, reviews, partnership codes, rewards, or promotions;
  • harass, threaten, or abuse renters, drivers, hosts, partners, WIGO personnel, or the public;
  • damage, steal, conceal, tamper with, disable, or abandon a vehicle or safety device;
  • scrape, reverse engineer, overload, probe, attack, or interfere with WIGO systems; or
  • use WIGO in a manner that violates these Terms, another person's rights, road-safety rules, insurance requirements, or applicable law.

14. Third-party services

WIGO may rely on third parties for payments, identity verification, maps, location search, communications, hosting, analytics, roadside assistance, insurance support, and other functions. Third-party services may have separate terms and privacy notices. WIGO is not responsible for third-party products or services outside its control, except where applicable law provides otherwise.

15. Intellectual property

The WIGO name, logos, software, designs, text, graphics, and service content are owned by WIGO or its licensors and protected by applicable law. Except as expressly permitted, users may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works from the service without written permission.

16. Privacy

WIGO processes personal data as described in the WIGO Privacy Policy. By using the service, users acknowledge that rental operations require processing information about accounts, drivers, hosts, vehicles, locations, reservations, payments, trip evidence, communications, and safety incidents.

17. Suspension and termination

Users may stop using WIGO at any time, subject to outstanding rentals, payments, claims, and other obligations. WIGO may restrict, suspend, or terminate an account, listing, reservation, feature, or access where reasonably necessary to protect users or vehicles, investigate fraud or safety concerns, comply with law, recover amounts owed, or enforce these Terms.

Provisions that by their nature should survive termination remain effective, including payment obligations, licenses, privacy provisions, intellectual-property terms, disclaimers, liability limitations, indemnities, and dispute provisions.

18. Service availability and disclaimers

WIGO may change, suspend, or discontinue features, service areas, eligibility requirements, or technical interfaces. We aim to provide a reliable service but do not guarantee uninterrupted, error-free, or continuously available access.

To the fullest extent permitted by law, WIGO is provided "as is" and "as available". WIGO does not guarantee that every listing, host, renter, driver, vehicle, price, location, photo, review, or third-party service will always be accurate, available, safe, or suitable for a particular purpose. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

19. Limitation of liability

To the fullest extent permitted by law, WIGO is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, loss of goodwill, vehicle downtime, or business interruption arising from or relating to the service.

Where liability cannot be excluded, WIGO's liability is limited only to the maximum extent permitted by applicable law. These limitations do not apply where prohibited by law.

20. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless WIGO and its personnel, contractors, partners, and affiliates from claims, losses, liabilities, damages, fines, penalties, and reasonable costs arising from your breach of these Terms, unlawful conduct, misuse of a vehicle or the service, submitted content, or infringement of another person's rights.

21. Governing law and disputes

The governing law and competent forum may depend on the WIGO entity, rental market, and mandatory consumer or vehicle-rental laws identified for the booking. Mandatory rights available in a user's place of residence or rental location are not excluded.

Before starting formal proceedings, users and WIGO should attempt in good faith to resolve the issue through WIGO support, unless urgent relief is required or applicable law permits direct recourse to a court, regulator, or other authority.

22. Changes to these Terms

WIGO may update these Terms to reflect changes in the service, law, safety practices, or business operations. For material changes, WIGO will take reasonable steps to notify users. Updated Terms apply from the stated effective date; changes will not retroactively alter a confirmed rental unless required by law or agreed by the affected parties.
